UNIC Statement on Unethical Practices in Pharmacy Chains

As part of the information campaign against unfair practices in the pharmaceutical market, the All-Ukrainian Integrity and Compliance Network (UNIC) continues to report possible cases of such practices.

Recently, reports have emerged about potential unethical and illegal actions involving pharmaceutical companies and pharmacy chains. These actions include programs whereby pharmacies are incentivized to recommend specific drugs or dietary supplements. Under such programs, pharmacists suggest patients replace prescribed medications with alternatives from participating manufacturers. If patients consent, the pharmacy and its employees receive financial rewards. Regrettably, such programs may be presented as part of the government-endorsed "National Cashback" program, which aims to support Ukrainian production and the economy, potentially misleading consumers to associate these unethical practices with the official program.

This practice is concerning, as it may constitute an undue benefit for pharmaceutical workers, violating several Ukrainian and international ethical standards.

This is especially alarming, as patients may be offered medications not based on medical needs but on the financial incentives of manufacturers, pharmacy chains, or pharmacists. Such substitutions during the sales process can interfere with the doctor-recommended treatment plan, potentially leading to negative health consequences.

Furthermore, the use of cashback programs can distort competition in the pharmaceutical market. Pharmacy chains engaged in these programs may grant certain manufacturers an unfair advantage, potentially fostering unfair competition and negatively affecting other market participants.

As of December 18, 2024, new legislation will come into effect prohibiting medical and pharmaceutical workers from accepting rewards, bonuses, or other benefits from entities involved in the production or sale of medicinal products. The Network urges all participants in the pharmaceutical market to respect these standards and uphold fair competition and ethical conduct.

We invite pharmacy chains and pharmaceutical companies to:
- Refrain from engaging in unethical and illegal practices;
- Report any instances of such practices to relevant authorities for appropriate action and accountability;
- Uphold high ethical standards, prioritizing patient health and supporting fair competition in the pharmaceutical market.
